Terms of Service — Emochi AI

These terms set out what you can expect from Emochi AI and what Emochi AI expects from you. Read them before creating an account.

1. AgreementThese Terms of Service form the agreement between you and Emochi AI covering your use of emochi-ai.com and any chat opened from it.
2. AcceptanceUsing Emochi AI means you accept these terms in full. If any part is unacceptable to you, do not use the service.
3. EligibilityYou must be at least 18 years old and legally able to enter into a contract in your jurisdiction.
4. Description of the serviceEmochi AI provides conversation with fictional companion characters. It is entertainment and companionship, nothing more.
5. Not a real relationshipCompanions are written characters generated by software. Nothing on Emochi AI should be understood as contact with a real person.
6. No professional adviceContent produced by a companion is not medical, psychological, legal or financial advice. Consult a qualified professional for those matters.
7. EmergenciesEmochi AI is not a crisis service. If you or someone else is in danger, contact local emergency services immediately.
8. Account creationYou are responsible for the accuracy of the details you register and for keeping your login credentials confidential.
9. Account securityNotify us promptly if you believe your account has been accessed without permission. You remain responsible for activity carried out under your login.
10. One account per personAccounts are personal. You may not share, transfer, resell or operate multiple accounts to evade limits or restrictions.
11. Acceptable useYou agree not to use Emochi AI to harass others, break the law, distribute malware, or attempt to disrupt the service.
12. Prohibited contentRequests involving minors, non-consensual scenarios, violence against real people, or other illegal material are forbidden and may be reported.
13. Automated accessScraping, crawling, bulk downloading or automated interaction with Emochi AI without written permission is not allowed.
14. Reverse engineeringYou may not decompile, reverse engineer or attempt to extract underlying models, prompts or source code from the service.
15. Your contentYou keep ownership of the messages you write, and you grant Emochi AI the licence needed to store and process them so the service can work.
16. Our contentSite design, text, imagery, character biographies and branding belong to Emochi AI or its licensors and may not be copied without permission.
17. TrademarksThe Emochi AI name and logo may not be used in a way that suggests endorsement or affiliation that does not exist.
18. Generated outputConversation output is produced automatically and may be inaccurate, inconsistent or unintentionally repetitive. Treat it as fiction.
19. AvailabilityWe aim to keep Emochi AI online continuously but do not guarantee uninterrupted access. Maintenance and outages happen.
20. Changes to the serviceFeatures may be added, changed or removed. We will avoid material reductions to paid features without notice where practical.
21. Free and paid accessSome features are free and others require payment. Prices, inclusions and limits are shown before any purchase is confirmed.
22. BillingPaid plans renew automatically for the stated period unless cancelled before the renewal date. Applicable taxes may be added.
23. CancellationYou may cancel a paid plan at any time. Access continues until the end of the period already paid for.
24. RefundsRefunds are handled according to the policy in force at the time of purchase and any mandatory consumer rights in your country.
25. ChargebacksRaising a chargeback without contacting support first may result in suspension while the dispute is investigated.
26. Third-party servicesPayment, hosting and delivery partners have their own terms, which apply to the parts of the service they provide.
27. Suspension and terminationWe may suspend or close an account that breaches these terms, harms other members, or presents a security or legal risk.
28. Ending your useYou may stop using Emochi AI and delete your account at any time through your account settings.
29. Disclaimer of warrantiesEmochi AI is provided on an as is and as available basis, without warranties beyond those that cannot be excluded by law.
30. Limitation of liabilityTo the extent permitted by law, Emochi AI is not liable for indirect or consequential losses arising from use of the service.
31. IndemnityYou agree to cover claims brought against Emochi AI that arise from your misuse of the service or breach of these terms.
32. Governing lawThese terms are governed by the laws applicable at the place of establishment of Emochi AI, without regard to conflict of law rules.
33. SeverabilityIf any clause is held unenforceable, the rest of these terms continue in force unchanged.
34. Changes to these termsTerms may be revised. The revision date is shown below and continued use after publication means acceptance.
